Not On Our Watch: Why California Must Bar the Door to New Mexico’s Pretrial Nightmare
The foundational principle of American justice is simple, you are presumed innocent until proven guilty. But right now, across the United States, a quiet bureaucratic movement is attempting to flip that principle on its head under the guise of "compassionate reform."
Look no further than New Mexico. In 2016, voters there were sold a sweeping promise, eliminate wealth-based detention and keep only the "truly dangerous" behind bars. Fast forward to today, and the reality of that risk-based, zero-money model is a constitutional nightmare. It has stripped away the affirmative right to bail, replaced individualized justice with cold algorithmic "risk scores," and forced countless legally innocent individuals to fight their cases from behind bars with absolutely zero path to release. It is a warning written in neon, and it is exactly the trap that California must fight tooth and nail to avoid.
The promoters of these radical pretrial reforms use the "wealth" argument because it makes for an emotional, high-impact soundbite on a ballot measure. They frame the traditional bail system strictly as a financial transaction where the rich buy their way out and the poor languish. But their "solution" to this problem is completely upside down. Instead of ensuring individualized, reasonable bail amounts for minor offenses, they choose to blow up the entire accountability structure.
What these critics completely ignore is the operational reality of how a bond actually functions: it isn't a wealth check; it’s a co-signing process designed to surround an arrested individual with a network of deep, localized accountability.
A professional bail underwriter doesn’t just look at a defendant as a standalone risk score on a spreadsheet. They identify human anchors mothers, spouses, siblings, and lifelong friends, to establish what can only be described as "sentimental equity." When a family steps up to sign as an indemnitor, they are wrapping the defendant in a localized support system. The true accountability doesn't come from the premium paid; it comes from the defendant knowing that their family’s home, savings, or livelihood is on the line. It creates a powerful, real-world social contract that keeps the defendant grounded, ensures they show up to court, and assists them in navigating their defense from a position of freedom. When you remove the commercial option, you take away the only mechanism that allows working-class families to pool their resources and secure a massive financial guarantee for a loved one's liberty.
Without this commercial bail option and human financial incentives, you don't get a fairer system, you get a system of absolute extremes where the middle ground is completely erased. In New Mexico, judges are forced into a dangerous, binary choice. On one hand, they have preventive detention jail with no way out. If a prosecutor files a motion for detention, a judge navigating vague statutory guidelines can order a person locked up with zero option for bond. A defendant sitting in a county jail cell cannot easily meet with counsel, secure evidence, or maintain employment. They are effectively punished before a jury hears a single shred of evidence, creating immense leverage for the state to coerce plea bargains from innocent people just looking to buy back their freedom. On the other hand, if the state fails to meet its high evidentiary burden for preventive detention, the court is forced into the opposite extreme: unsupervised release. With no skin in the game and no localized accountability, repeat offenders walk right back out onto the streets hours after an arrest, creating a revolving door that undermines public safety and fractures community trust.
California has long been the primary target for these sweeping pretrial experiments, but our state has consistently fought back to preserve the balance of true justice. In 2020, Sacramento tried to force a total ban on cash bail through SB 10, but the public saw through the rhetoric. In a decisive rejection, California voters passed Proposition 25, vetoing the ban and protecting the commercial bail industry as a vital constitutional safety valve.
More recently, the California Supreme Court issued a landmark, unanimous ruling in In re Kowalczyk that draws a definitive line in the sand. The Court reaffirmed that pretrial release is the norm, and detention is a strictly limited exception. The justices made it clear that judges cannot use artificially high bail to bypass the constitution, but they must respect Article I, Section 12 of the California Constitution. True preventive detention is reserved strictly for capital crimes and specific violent felonies where there is clear and convincing evidence of a substantial threat of bodily harm. This ruling is a massive victory for due process, preventing California from sliding down the slippery slope toward New Mexico’s blanket preventive detention model and keeping the decision-making tethered to our state constitution, not to political trends or experimental algorithms.
Yet, the pressure to push California into a New Mexico style model hasn't stopped. We see it in persistent, targeted legislative overreaches designed to slowly strangle the pretrial industry from the edges. Whether it is bills like AB 1927, which attempts to tie the hands of professional agents through aggressive restrictions under the guise of "consumer protection," or SB 1026, which seeks to overburden the recovery professionals who keep the system accountable, the underlying goal remains the same: to dismantle the private bail mechanism piece by piece until the state has total control. Lastly, SB 526 is yet another attack.
We can’t allow that to happen. If we strip away the right to a commercial bond, we leave defendants with only two choices: have enough independent cash to pay the court directly, or sit in a county jail with no way out. California must remain a state where the presumption of innocence is protected by a tangible, constitutional right to bail. We must reject the radical pretrial models that trade basic human liberty for state-run machines. Let's keep our courts accountable, our communities safe, and our constitutional rights intact.
